Terms and general conditions of use (and sale) of Blog do Marcelo.

The services of Blog do Marcelo are provided by the legal entity with the following Corporate Name: , doing business as Blog do Marcelo, registered with CNPJ under no. , holder of the intellectual property rights over software, website, applications, content, and other assets related to the Blog do Marcelo website.

1. Subject matter

The platform aims to license the use of its software, website, applications, and other intellectual property assets, providing tools to assist and streamline the daily lives of its users.

The platform is characterized by the provision of the following service: news dissemination.

2. Acceptance

This Agreement establishes contracted obligations of free and spontaneous will, for an indefinite period, between the platform and individuals or legal entities, users of the Blog do Marcelo website.

By using the platform, the user fully accepts these rules and undertakes to observe them, under the risk of the application of appropriate penalties.

Acceptance of this instrument is essential for access to and use of any services provided by the company. If you do not agree with the provisions of this instrument, the user should not use them.

3. User access

All technical solutions available to the platform manager will be used to enable access to the service 24 (twenty-four) hours a day, 7 (seven) days a week. However, browsing the platform or any of its pages may be interrupted, limited, or suspended for updates, modifications, or any action necessary for its proper functioning.

4. Registration

Access to the platform’s features will require prior registration and, depending on the chosen services or products, the payment of a certain amount.

When registering, the user must provide complete, up-to-date, and valid information, being solely responsible for keeping such data updated, as well as the user commits to the accuracy of the provided data.

The user agrees not to provide their registration and/or access data to third parties, being fully responsible for their use.

Individuals under 18 years of age and those who do not have full legal capacity must obtain the express consent of their legal guardians prior to using the platform and its services or products. The responsibility for any access by minors and those without full legal capacity without prior authorization is solely of the legal guardians.

By registering, the user expressly declares and guarantees to be fully capable, being able to freely exercise and enjoy the services and products.

The user must provide a valid email address, through which the site will make all necessary communications.

After confirming the registration, the user will have a login and a personal password, which ensures the individual access to it. Therefore, it is the user’s sole responsibility to maintain said password confidential and secure, avoiding undue access to personal information.

Any and all activity carried out using the password will be the user’s responsibility, who must promptly inform the platform in case of misuse of the respective password.

It will not be allowed to assign, sell, rent, or transfer, in any way, the account, which is personal and non-transferable.

It is the user’s responsibility to ensure that their equipment is compatible with the technical characteristics that enable the use of the platform and its services or products.

The user may, at any time, request the cancellation of their registration with the Blog do Marcelo website. Their deregistration will be carried out as quickly as possible, provided that no outstanding debts are found.

By accepting the Terms and Privacy Policy, the user expressly authorizes the platform to collect, use, store, process, assign, or use the information derived from the use of the services, the site, and any platforms, including all information filled in by the user at the time of registering or updating their registration, as well as others expressly described in the Privacy Policy that must be authorized by the user.

5. Responsibilities

It is the user’s responsibility to:

a) defects or technical flaws originated in the user’s own system;

b) the correct use of the platform, the services, or products offered, promoting good coexistence, respect, and cordiality among users;

c) compliance with and respect for the set of rules set forth in this General Conditions of Use Term, in the respective Privacy Policy, and in national and international legislation;

d) the protection of access data to their account/profile (login and password).

It is the responsibility of Blog do Marcelo to:

a) indicate the characteristics of the service or product;

b) defects and flaws found in the service or product offered provided that it caused them;

c) the information it has disclosed, with comments or information disclosed by users being the sole responsibility of the users themselves;

d) the content or illegal activities carried out through its platform.

The platform is not responsible for external links contained in its system that may redirect the user to an environment outside its network.

External links or pages serving for commercial or advertising purposes, or any illegal, violent, controversial, pornographic, xenophobic, discriminatory, or offensive information, cannot be included.

6. Copyrights

This Terms of Use grants users a non-exclusive, non-transferable, and non-sublicensable license to access and use the platform and the services and products made available by it.

The structure of the website or application, trademarks, logos, trade names, layouts, graphics and interface design, images, illustrations, photographs, presentations, videos, written and sound content, and audio, computer programs, database, transmission files, and any other information and intellectual property rights of the corporate name, subject to the terms of the Industrial Property Law (Law no. 9,279/96), Copyright Law (Law no. 9,610/98), and Software Law (Law no. 9,609/98), are duly reserved.

This Terms of Use does not assign or transfer to the user any rights, so access does not generate any intellectual property rights for the user, except for the limited license hereby granted.

The user’s use of the platform is personal, individual, and non-transferable, and any unauthorized, commercial, or non-commercial use is prohibited. Such uses will constitute a violation of the intellectual property rights of the corporate name, punishable under applicable law.

7. Sanctions

Without prejudice to other legal measures, the corporate name may, at any time, warn, suspend, or cancel the user’s account:

a) that violates any provision of this Agreement;

b) that fails to comply with its user duties;

c) that has any fraudulent, dishonest behavior, or that offends third parties.

8. Termination

Failure to observe the obligations agreed upon in this Terms of Use or the applicable law may, without prior notice, result in immediate unilateral termination by the corporate name and the blocking of all services provided to the user.

9. Amendments

The items described in this instrument may be unilaterally and at any time amended by , to adjust or modify the services, as well as to meet new legal requirements. The changes will be published by the Blog do Marcelo website, and the user may choose to accept the new content or to cancel the use of the services if they are subscribed to any service.

The services offered may, at any time and unilaterally, and without any prior notice, cease to be provided, be changed in their characteristics, as well as restricted for use or access.

10. Privacy Policy

In addition to this Agreement, the user must consent to the provisions contained in the respective Privacy Policy to be presented to all interested parties within the platform interface.

11. Jurisdiction

For the resolution of disputes arising from this instrument, Brazilian and United States Laws will be fully applied.

Any disputes shall be submitted to the court of the district in which the company’s headquarters are located.
